Three New Criminal Laws Passed in Lok Sabha: Three new criminal laws have been successfully passed in the Lok Sabha. The next step is to present them in the Rajya Sabha, and upon approval, they will be sent to the President for final clearance.

Abolishing Sedition Law and Capital Punishment for Rape and Mob Lynching

While presenting the bills, Home Minister Amit Shah stated that the sedition law, enacted during the British era, has now been abolished. Capital punishment will be imposed for crimes such as rape and mob lynching involving minors.

Imprisonment for Armed Rebellion and Damaging National Property

Regarding the bill on armed rebellion and causing harm to the country’s property, Amit Shah mentioned in the Lok Sabha that the sedition law, crafted by the British, had led to the imprisonment of several national leaders, including Tilak, Gandhi, and Patel, for multiple six-year terms. The law has been in effect until now.

“I have replaced sedition with treason because the country is now independent, and in a democratic nation, anyone can criticize the government. If someone engages in activities that harm the security and property of the country, action will be taken against them,” Amit Shah stated.

“There will be repercussions for anyone who carry out bombings or participate in armed resistance. They won’t have the right to remain free; they will have to go to jail. Some may attempt to interpret it according to their understanding but understand what I have said clearly. Those opposing the country will have to go to jail.”

Death Penalty for Rapists of Minors and Gang Rape Offenders

Previously, Sections 375 and 376 covered rape offenses. Now, amendments in Sections 63 and 69 specifically address rape from the beginning of criminal acts. The law also includes provisions for gang rape offenders. Offenses against children have been further emphasized. Murder, previously under Section 302, is now under Section 101.

Offenders convicted of raping a girl below 18 years of age may face life imprisonment or the death penalty. Those found guilty of gang rape may receive a sentence of up to 20 years or imprisonment until death.

Division of Non-Intentional Homicide into Categories

The proposed law has divided non-intentional homicide into two categories. If an accident occurs while driving, and the accused takes the injured to the police station or hospital, they will receive a lesser penalty. In hit-and-run cases, a sentence of 10 years is prescribed.

Capital Punishment for Mob Lynching

In cases of mob lynching, the penalty is capital punishment. Previously, there was no law specifically addressing snatching, but now, anyone causing head injuries to another person may face a sentence of 10 years in a brain-dead condition.

Police Accountability Determined

Home Minister Amit Shah stated that the new law would also hold the police accountable. Now, when someone is arrested, the police will inform the person’s family. Previously, this was not mandatory. The police will now provide information to the victim about what happened within 90 days in any case.

Trial Even in the Absence of the Accused

In the country, there are cases pending where the accused in cases like Bombay blasts are hiding in countries like Pakistan. Now, there is no need for them to come here. If they do not appear before the court within 90 days, the trial will proceed in their absence.

Possibility of Release After Serving Half the Sentence

In serious cases, after serving half the sentence, there may be a possibility of release. Judgments cannot be pending for years. After the completion of the case, the judge must make a decision within 43 days. The sentence must be pronounced within 7 days of making the decision. Earlier, mercy petitions were filed for years.

Mercy Petition Can Only Be Filed by the Convicted

Previously, NGOs or institutions could file mercy petitions. After rejection by the Supreme Court, a mercy petition can be filed within 30 days.

Activities Jeopardizing the Unity, Integrity, and Security of the Country Considered Terrorism

Those who engage in activities jeopardizing the unity, integrity, and security of the country will be considered terrorists. What changes will occur with the three bills?

Many sections and provisions will change. Out of 511 sections in the IPC, 356 will remain. 175 sections will be modified. Eight new sections will be added, and 22 sections will be eliminated. Similarly, in the CrPC, 533 sections will remain. 160 sections will be modified, 9 new ones will be added, and 9 will be eliminated. Provision for conducting video conferences from investigation to trial, which was not there before, will be included.

Major Change: Maximum 3 Years for Court Decision

The most significant change is that now the trial court must give a decision within a maximum of 3 years. There are 5 crore pending cases in the country, and 4.44 crore cases are in the trial courts.

Similarly, out of the 25,042 positions of judges in district courts, 5,850 positions are vacant.

Suspension of 13th Day of the Winter Session of Parliament

On the 13th day of the winter session of Parliament (Wednesday), two more Lok Sabha MPs were suspended. Kerala Congress (M) leader Thomas Chazhikadan and Makkal Padai MP A.M. Arif were suspended for showing banners and entering the well of the House.
